Maxim 8.6.5

No man ought to be twice vexed for one and the same cause.

Explanation

The prohibition against double jeopardy and duplicative litigation is fundamental — once a matter has been properly determined, it may not be relitigated between the same parties.

Where this applies

  • I was acquitted of a crime and now they're trying to charge me again for the same thing.
  • The plaintiff lost the first trial and filed the same lawsuit again.
