Maxim 8.2.15

No one can verify by jury against a record.

Nemo potest contra recordum verificare per patriam.

Source: 2 Inst. 380; Wharton Difficulty 3/5 — Intermediate

Explanation

A court record cannot be contradicted or overturned by jury verdict — the record speaks for itself and is conclusive as to what it contains.

Where this applies

  • The court record says one thing but a jury later found something different — the record wins.
  • An official court transcript can't be overridden by later jury findings.
