Maxim 7.2.11
The fraud of a predecessor does not prejudice the successor.
Dolus auctoris non nocet successori.
Source: Bouvier's Law Dictionary; Weisman, 29e
Difficulty 2/5 — Approachable
Explanation
A successor in title or office is not tainted by the fraud of his predecessor — each person answers for his own deceit, and no innocent party inherits another's guilt.
Where this applies
- The previous owner committed fraud but the new owner is innocent — is the new owner tainted?
- I bought a business that had a history of fraud under the prior management — am I liable?
