Maxim 8.8.1

Hear the other side.

Audi alteram partem.

Source: Broom, Max. 113; 6 Co. 52a; 4 Bl. Comm. 283 Difficulty 1/5 — Foundational

Explanation

No judgment may be rendered against any person without giving him notice and an opportunity to be heard — this is the irreducible minimum of due process of law.

Where this applies

  • I was sued and never received any notice of the lawsuit before the judgment was entered.
  • The court ruled against me without giving me a chance to tell my side.
