Maxim 11.2.14

False spelling or false grammar does not vitiate a grant.

Explanation

A grant or deed is not defeated by mistakes in spelling or grammar; the law looks to the substance of what is conveyed, not to the accuracy of the penmanship. (Duplicate maxim — see also 9.5.11.)

Where this applies

  • A grant is being challenged because of typos and grammatical errors.
  • The spelling is wrong but the meaning and intent are perfectly clear.
  • Minor writing errors don't invalidate a grant when the substance is understood.
