Maxim 10.1.18

To interpret and reconcile laws so that they harmonize is the best mode of construction.

Explanation

Where statutes appear to conflict, the best interpretation is one that reconciles them into a consistent whole, rather than declaring one void. (Duplicate maxim — see also 6.4.10.)

Where this applies

  • Two laws seem to conflict but there should be a way to read them together harmoniously.
  • Instead of declaring one statute void, the court should try to reconcile both laws.
  • The best interpretation is one that makes all the laws work together consistently.
