A curious and captious interpretation in the law is to be reproved.

Explanation

Ingenious but strained constructions that trap the unwary or twist ordinary language into unforeseen meanings are condemned; the law favors plain and honest reading. (Duplicate maxim — see also 10.3.11.)

Where this applies

  • The other side is using a clever but twisted reading of the contract to trap me.
  • A strained and ingenious interpretation is being used to twist ordinary language.
  • The court should reject tricky interpretations in favor of honest and plain readings.
