The malicious plans of men must be avoided.

Explanation

(English-origin maxim.) Schemes born of malice carry no legal protection — the law recognizes and frustrates malicious designs rather than giving them effect.

Where this applies

  • A scheme designed to harm another under the cover of a lawful-looking transaction is challenged.
  • A party structures a deal specifically to injure a competitor, and the malice is exposed.
