Maxim 6.2.9

Those things which agree in substance do not differ, though they be not expressed in the same words.

Non differunt quae concordant re, tametsi non in verbis iisdem.

Explanation

The law regards substance, not form — agreements that achieve the same effect by different words are treated alike.

Where this applies

  • The two agreements use different wording but accomplish the same thing.
  • We signed slightly different versions of the contract but both say essentially the same thing.
