Maxim 5.6.27
A yearly increase goes to enhance the inheritance.
Source: Dig. 5, 3, 20, 3; Weisman, 58hh
Difficulty 3/5 — Intermediate
Explanation
(English-origin maxim.) Annual profits and increase of the estate augment the inheritance — rents, crops, and natural increase of livestock all pass to the heir as part of the inherited estate.
Where this applies
- A farm produces annual rents that accumulate during the probate period, and all those rents pass to the heir as part of the inherited estate.
- A vineyard's yearly grape harvest increases the value of the inherited property, and the heir receives both the land and the accumulated profits.
- Livestock on inherited land produce offspring each year, and those natural increases belong to the heir as part of the inheritance.
