Maxim 5.1.41

He has better title who was first in point of time.

Explanation

(English-origin maxim.) Priority in time gives superiority of right — the first to establish a claim has the better title, all else being equal.

Where this applies

  • Two buyers claim the same parcel and the one who acquired rights first prevails.
  • Competing liens on the same property are ranked by which was established earliest.
