Explanation

(English-origin maxim.) Vigilantibus non dormientibus aequitas subvenit — equity aids the vigilant. Those who sleep on their rights lose them; those who act promptly are protected.

Where this applies

  • A creditor waited a decade to collect a debt and the debtor argues the claim is too old to pursue.
  • A person who failed to record their deed loses priority to someone who recorded promptly.
